Website Reaction terms and conditionsThese terms apply to domain name registration, website and internet services provided by Website Reaction under the trading names of websitereaction.com and websitereaction.co.uk.

In the following, 'we', 'our', or 'us' means Website Reaction, and 'you', 'your' or 'the customer' means you the subscriber to our services. 'Services', or 'account' refers to services provided by us to you.

You are required to adhere to these terms and conditions or any Acceptable Use Policies (AUP) as and when these are published by us. If you breach these terms or those of our AUP we reserve the right to terminate your account with us at our sole discretion without notice or refund.

A deposit for our services is required in advance. You will be notified when renewal fees become due and will be expected to pay them within 30 days of notification. If payment is not received within this period the services may be suspended or cancelled.

We will attempt to register your domain names immediately, but it is possible for names to appear to be available when placing an order but in reality to have been registered by someone else (there is a lag in the whois database being updated after registration occurs). If you register a name that subsequently turns out to have not been available we will of course issue a full refund. We cannot be held responsible for any other costs incurred in connection with this, you should check thoroughly that the domain names you ordered have been assigned to you before publicising them in any way. After registration, by default we will point your domain name website address to a free parked page for your domain, this page may contain advertising links.

You should ensure you know the expiry date of your domain names and renew them in good time before expiry. We will telephone you or send reminder emails to the account address as registered in good time before renewal is due. But we cannot be held accountable if you do not receive these emails and a domain name is deleted due to non-renewal. It is very important that you keep your account email address up to date.

Once an order has been received, either by telephone, or email, all fees become due. Once a domain has been registered it isn't possible for us to delete the domain or hosting account, so we therefore cannot offer refunds for unwanted domains or services.

As part of the registration process, you are required to provide certain information and to update this information to keep it current, complete and accurate. This information includes: (i) your full name, postal address, e-mail address and, telephone number; (ii) the name of an authorised person for contact purposes in the case of a registrant that is an organisation, association, or corporation. You acknowledge that providing inaccurate information or failing to update information promptly will constitute a material breach of this Agreement and will be a basis for cancellation of your domain name.

You acknowledge that we will make some of the information that you provide during the registration process publicly available as required by the registry for your domain name. Additionally, you acknowledge that the registry for your name may impose guidelines, limits and/or requirements that relate to the amount and type of information that we may or must make available to the public or to private entities. We will not otherwise disclose your information to any third party unless it is required to maintain your domain name. You may request a copy of your information in our possession to review, modify or update such information.

In addition to our terms and conditions as set out here, you must also agree to be bound by the terms and conditions of the registries we use to secure your domain name, specifically:

For .uk domains, UK terms and conditions.
For .com/net/org/biz/info domains, INWW terms and conditions.
For .xx.com/.xx.net CentralNic second level domains, CentralNic terms and conditions.
You also agree that any dispute arising from your domain registration will be bound by the appropriate dispute resolution policy, specifically:

For .uk domains, Nominet Dispute Resolution Service
For .com/net/org/biz/info domains, ICANN Uniform Domain-Name Dispute-Resolution Policy.
In addition, you agree to indemnify us for all costs resulting from any such dispute.

When registering a domain name, you must have the right to use the name and by registering it you are confirming that you do have that right.

If you sell or transfer ownership of a domain, there may be a charge levied by our registrars for changing the owner's name/address details, you will be liable for this charge.

You may cancel your service at any time, but you must give us at least 14 days notice in writing of your intention to cancel. No fees for unused months of a service provided by us are refundable.

We reserve the right to take legal action to recover any debts.

We reserve the right to apply an administration charge for late or non-payment of an account. This fee shall not exceed £150 plus the amount outstanding.

You may not use our internet services to promote, distribute or advertise:
Firearms and other weapons.
Pornographic, racist, homophobic or other offensive material.
Material which breaches a third parties intellectual property rights including copyright or other trade secrets.
SPAM email, including bulk email software and lists of email addresses, except where all of the addressees have given their permission.

You may not use our internet services to abuse or deny services to other internet users. This includes, but is not limited to, mail bombing and sending abusive email. You also may not use our services to infringe the privacy of others, publish libelous or illegal material, or publish any material deemed to be in breach of the Data Protection Act.

We will not host or advertise domain names which in themselves could be deemed offensive to others.

Where we advertise your domain name as 'for sale', we make no guarantees that the name will be sold. You are responsible for dealing with the sale of the domain name. We will not be responsible for any losses incurred by either the seller or the purchaser. We will endeavour to display the name for a minimum of one year, and we may contact the seller periodically to ensure a domain name is still for sale.

You must not promote services we supply, or your own sites hosted on or forwarded to by our servers, using methods such as bulk emailing or excessive news group postings, or posting to newsgroups whose charter specifically prohibits advertising. You must also not use the webspace provided to disseminate large files, such as mp3 samples etc.

You must not use our servers to send Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE)

We reserve the right to suspend or terminate any account or service at our sole discretion.

Where it says "Unlimited" in any of the specifications or features for our products or services, this means that we do not explicitly impose any limit. There may be practical limits on the usage of these features however.

We are not responsible for any use you make of our services. In addition you agree to indemnify us against any of the effects of your use or misuse of our services, or claims resulting from that use or misuse.

We shall take reasonable measures to endeavour to maintain our services, but you will not be eligible for any compensation because of any loss or unavailability of any service we provide. We reserve the right to change any service at any time.

We shall not be held responsible for any loss however caused resulting from any suspension or unavailability of any service.

You are responsible for any material stored on our servers. We shall not be held responsible for any loss, however caused, of this material.

You are required to keep the contact details you provided to us up to date. We may use these addresses to contact you by post or email from time to time, but these addresses will not be passed to any other companies, unless required in order to register a domain name.

You will keep your password secret and will not disclose it to any third party. You will notify us and change any password you believe has been compromised.

The email facilities we provide are intended to allow you to provide a professional presence for you or your company.

These terms and conditions shall be governed by and construed in accordance with the laws of England and the customer agrees to submit to the exclusive jurisdiction of the English courts. Each version of this Policy will be identified at the top of the page by its effective date, and we will also keep prior versions of our terms and conditions in an archive for your review

Competitions

1. The Win the prize draw (the "Prize draw") is open to UK residents aged 18 and over ("You") subject to paragraph 2. below.
2. Employees or agencies of Website Reaction its group companies or their family members, or anyone else connected with the Prize draw may not enter the Prize draw.
3. By entering the Prize draw you are accepting these terms and conditions.
4. To enter the Prize draw, you must fill in your details as requested and click the 'Submit' button. If You have any questions about how to enter or in connection with the Prize draw, please e-mail us.
5. Only one entry is permitted per person.
6.The closing date and time of the Prize draw is Midnight on December 31st 2010. Entries received after that date and time will not be considered.
7. One winner will win an Apple iPad, Wi-Fi, 16GB.
8. The winners will be notified by Website Reaction by email. If a winner does not respond to Website Reaction within 7 days of being notified by Website Reaction, then the winner's prize will be forfeited and Website Reaction shall be entitled to select another winner (and that winner will have to respond to the email from Website Reaction within 7 days or else they will also forfeit their prize). If a winner rejects their prize, then the winner's prize will be forfeited and Website Reaction shall be entitled to select another winner.
9. The prize will be sent to the winner by Website Reaction.
10. The prize cannot be exchanged or transferred by You and cannot be redeemed by You for cash or any other prize. You must pay all other costs associated with the prize and not specifically included in the prize.
11. We retain the right to substitute the prize with another prize of similar value in the event that the original prize offered is not available.
12. We take no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
13. Details of the winner can be obtained by contacting Website Reaction.
14. No purchase is necessary.
15. The winner may be required for promotional activity.
16. The Promoter of the Prize draw is Website Reaction.
17. Nothing in these Terms and Conditions shall exclude the liability of Website Reaction for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
18. Website Reaction accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by You as a result of entering the Prize draw or accepting any prize. Website Reaction further disclaims liability for any injury or damage to You or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Prize draw.
19. Website Reaction reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of Website Reaction in all matters under its control is final and binding.
20. Website Reaction shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
21. The Prize draw will be governed by English law.
